Tuition and Policies

Choose Your Session

  • Prices reflect the ACH payment discount, please note all other forms of payment incur a 3.5% increase in pricing

FINANCIAL POLICIES

  • All families are required to keep a current electronic payment method on file in the LDP Parent Portal.
  • All tuition is non-refundable and non-transferable. Additionally, no credits will be issued for any reason, regardless of participation. No refunds or credits, in part or in full, are given for late sign-ups, early departures, or time off due to outside activities, illness, or injury.
  • Tuition is collected on the 1st of the month or the first business day that follows. No personal checks will be accepted.
  • All production fees, materials fees, costume deposits, professional video access fees, and company/crew annual fees are non-refundable and non-transferable, regardless of participation. 
  • All fees include a 3.5% discount for ACH payments. If the Client chooses to pay by credit card, the discount will be removed, resulting in an increased payment amount.
  • ACH must be marked as the primary payment method to receive the ACH pricing. No refunds are given if the Client does not have ACH marked as the primary payment method. 
  • Accounts on installment plans must be paid in full by the end of the season, regardless of participation, illness, injury, or early departure. Installments will continue to be charged until tuition is paid in full. 
  • Classes may be added at any point if classes are not at capacity and are the appropriate age and level for the student. 
  • One family account cannot be split between two different payment methods. 
  • LDP will assess a $35.00 fee for denied, returned, or NSF payments. 
  • Tuition payments not collected by the 15th of the month will be subject to a $35 late fee per week if the installment payment is past due. You MUST update your online account if your credit card or bank account information has changed or expired to avoid a $35 late fee. Our accounting department will automatically send any account that is more than two months past due to collections. 
  • Tuition rates are based on the number of total weeks classes are offered and are conveniently broken up into monthly, equally distributed payments. Therefore, tuition is charged monthly regardless of the number of weeks in the month. We do not charge more for months with 5 weeks, nor do we prorate for vacations or holidays. 
  • Our studio schedule is based on 34 lessons, not 11 months. Each class has approximately 34-39 lessons over the course of the dance year.
  • All tuition, annual fees, performance fees, and any additional fees incurred during the season must be paid in full to participate in classes, shows, competitions, and/or conventions. If an account is more than 20 days past due, the child may not be allowed to attend class until the account balance is paid in full. 
  • There are no tuition refunds for classes a Student is scheduled to attend, whether or not the Student attends the class, and there are no refunds for Membership Fees. Tuition rates are per student and are charged monthly by the Program Investment Sheet.
  • Siblings receive a 10% discount on tuition. 
  • Costume Fee increases by $50  if registering after October 31st (Fall Session/Winter Wonderland) or March 31st (Spring Session/Annual Review)
  • Dancers will not receive their costumes for Winter Wonderland or Annual Review if there is an outstanding balance on their account. 
  • Clients may not put accounts on hold for any reason. If a dancer is unable to attend class for any reason, makeup classes can be booked through the parent portal.
    • Makeup classes expire after 2 months.

Class Cancelation

    • Drop Request form must be submitted by the 15th of the month to stop the automatic tuition payments for the following month.
    • If a dancer drops after the 15th of the month, they will be charged a $35 late drop fee, or they can choose to drop at the end of the following month and will be charged normal tuition on the 1st
    • If you request to drop a class after the 15th of the month, you will be subject to a $35 late drop fee.
    • Your membership is discontinued upon dropping all classes from LDP. If you decide to return within the season, a membership fee will be charged.
  • June tuition will be charged for LDP FULL Experience members if dropping before the season ends. 

 

Homeschool Vouchers

  • All accounts that pay via Homeschool Vouchers must pay tuition fees in accordance with the general payment schedule.
  • LDP’s billing specialist must receive clients’ voucher orders by the 15th of the previous month in order to provide the appropriate amount of time to invoice for the upcoming month. 
  • Once registered, clients can check the balance via the LDP parent portal, LDP app, or phone at 916-668-8100.
  • Homeschool vouchers cannot be used to cover registration fees, experience fees, costume fees, or any other fees that are outside of your monthly tuition. 
  • LDP is happy to partner with several homeschool providers throughout the area. If LDP does not currently have a contract with a provider, please feel free to reach out to billing@leightondanceproject.com to see if the provider can be added to the list.
  • The first month of the dancer’s season must be paid upfront. Homeschool vouchers are not paid out until services are rendered, so families must cover their first month of tuition via a different form of payment. 
  • All families participating in homeschool vouchers must have an updated credit card or bank account on file at all times. 

 

Cutie Club (Fall Only Membership)

  • $50 (individual) or $75 (family) Membership fee will be charged upon registration
  • $100 Performance Fee per dancer will be charged on August 12th or upon registration, whichever comes first.
  • $80 costume fee per class will be charged on October 15th or upon registration, whichever comes first. 
    • Costume Fee increases by $50  if registering after October 31st
  • Monthly Installments are split into 5 equal payments and charged on the 1st of every month or the first business day that follows. (August, September, October, November & December)

 

Club (Fall Only Membership)

  • $50 (individual) or $75 (family) Membership fee will be charged upon registration
  • $100 Performance Fee per dancer will be charged on August 12th or upon registration, whichever comes first.
  • $90 costume fee per class will be charged on October 15th or upon registration, whichever comes first. 
    • Costume Fee increases by $50 if registering after October 31st

  • $90 costume fee per class will be charged on March 15th or upon registration, whichever comes first. 
    • Costume Fee increases by $50 if registering after March 31st.

Cutie Club (Full LDP Experience Membership)

  • $50 (individual) or $75 (family) Membership fee will be charged upon registration

Enrollment/Performance Policies

PROGRAM ENROLLMENT POLICIES

    • Students must meet the minimum age/grade requirement upon registration as well as any requirements specific to the program unless prior permission has been granted from LDP. 
  • Low Enrollment: LDP reserves the right to cancel a program at any time due to low enrollment. A minimum of five students is required to hold a class. 
  • Waitlist: The Front Desk will email the first person on the waitlist when a spot opens up. If the front desk does not receive a response from the client and the dancer is a no-show for the following class, LDP reserves the right to move to the next person on the waitlist. 

Performance Agreement

  • I understand that in enrolling in the Cutie Club or Club programs at Leighton Dance Project, I am committing to the program in its entirety.
  • I understand that my dancer is in the performance at the end of the session. 
    • Fall Members: Winter Wonderland, December 20th & 21st
    • Spring Members: Annual Review, June 13th & 14th
    • Full LDP Experience Members: Winter Wonderland, December 17th – 21st  & Annual Review, June 10th – 14th
  • If there are extenuating circumstances such as travel, etc., that means a dancer cannot perform in the actual performance:
    • Click here to submit a non-participation form. This form must be completed before the below dates before the performance fee and costume fee are charged. Refunds will not be issued for any charges if this form was not completed before the charge date. 
      • October 15th if opting out of Winter Wonderland
      • March 15th if opting out of the Annual Review
  • If a dancer needs to drop a Club class after the “Performance Fee” has been taken out, that fee is non-refundable.
  • If a dancer needs to drop a Club class after the Costume Fee has been taken out, that fee is non-refundable. However, they will still receive their costume.
  • A dancer must be a current member to participate in any LDP performances, including but not limited to Winter Wonderland and Annual Review. 

Medical and Risk Policies

MEDICAL RELEASE

I hereby give my permission to Leighton Dance Project (“LDP” for this agreement), its owners, operators, officers, directors, agents, supervisors, instructors, teachers, administrators, and agents to seek and give appropriate medical attention to Students in the event of an accident, injury, and/or illness. In case of an emergency, my child may be treated by a qualified physician. I understand that LDP does not assume responsibility for any injury or damage that might arise out of or in connection with such authorized emergency medical treatment. Student or Parent understands that no medical benefits or services will be provided during any LDP programs and that Student and/or Student’s insurance shall be solely liable to pay for any medical expenses incurred on Student’s behalf. 

PHYSICAL CONDITION

I, the Student, Parent, or Authorized Agent, represent and warrant to LDP that the Student has no physical or psychological problems that would prohibit the Student from participating in the activities at LDP. The parent has consulted a personal physician or has taken whatever steps deemed necessary to determine that the Student’s status is of good health with no conditions that might limit participation in activities offered by LDP, including but not limited to dance, acro, gymnastics, tumbling, performing arts, acting, singing, fitness, yoga, and pilates.

RISK OF INJURY

I, the Student, Parent, or Authorized Agent, recognize and acknowledge that activities offered by LDP (including but not limited to dance, acro, gymnastics, tumbling, performing arts, acting, singing, fitness, yoga, and pilates), whether in-person, outdoors or via online webcast, are strenuous exercise and vigorous physical activities and that such activities have an inherent risk of physical injury. That practice is dangerous and involves certain risks including, but not limited to (a) loss of, or damage to, personal property and (b) bodily injury, such as sprains or strains, impact injuries, and blisters or fatality. As a voluntary participant, Student understands and accepts all of these and other risks associated with participation at LDP, no matter how remote or unlikely. Additionally, with the use of outdoor activities, I recognize and acknowledge that there is an inherent risk of injury with regard to the proximity of street traffic, passersby, parking lot activities, and exposure to environmental elements. 

 

ONLINE CLASSES

LDP may, in its sole discretion, teach class through electronic means. In such instances, LDP will capture its classes on video, audio, and/or still images for broadcast to Students across the internet. By participating in such online classes, the Student and/or Parent grants LDP permission to use some or all of the Student’s name, profile information, visual likeness, voice recording, graphics, photographs, or other artwork and any other information (“Materials”) Student and/or Parent provides to LDP or its employees or agents (such as instructors) in one or more of its content, products, and advertising, in any form or format now known or hereafter created, and distributed or made available throughout the world in perpetuity, without notice, compensation to or further approval from Student and/or Parent. If the Student and/or Parent do not want the materials to be captured, published, or broadcast for such uses, then the Student and/or Parents must choose not to participate in an online class with LDP. Student and/or Parent understands and agrees that LDP shall be the exclusive owner of its products, content, and advertising, including those containing the Materials, and that Student and/or Parent is not entitled to any remuneration for such use. 

OUTDOOR CLASSES

*when applicable*

I understand and assume the risk involved in outdoor venues with direct or indirect access to street and/or parking lot traffic. Outdoor activities have an increased risk of heat exhaustion, heat stroke, and other heat-related illnesses. It is the Participant’s and/or Participant’s parent/guardian’s responsibility to ensure the Participant is properly hydrated and taking precautions from exposure to the sun, heat, cold, wind, and other environmental factors. I understand that the impact on the Student’s body, bones, joints, and other structures will be greater than said impact when utilizing the indoor studio floors, and therefore, presents an increased chance of injury to the Student. 

When you buy a ticket for an event at Leighton Dance Project, please know that you agree to abide by the terms set forth below. These rules are subject to change at any time under the discretion of Leighton Dance Project and our theatre partners. At this time, our ticketing policies include the following terms:

Ticket Delivery Methods

Tickets may be purchased in advance or at the door. Our delivery methods are as follows:

  1. Print at Home: This option allows you to print your tickets at home. 

  2. QR Code: Upon ordering, you are sent a QR code through either/or email and text. This QR code will act as your ticket at the door.

  3. There will be no “Will Call” or ticketing box office at the theatre, as all our tickets are done exclusively online.

Accessible Seating

ADA seating is available in all venues in which Leighton Dance Project partners. Should you need ADA or companion seating, email frontdesk@leightondanceproject.com for accommodations. Patrons booking accessible seating without need may be reassigned to other seats if an ADA need arises.

All ADA seats at the Cordova High School Theatre do not have a physical seat. Do not book one of these seats unless you are a wheelchair-using person.

Cancellations

  • If, by any event, Leighton Dance Project should cancel a performance, our staff will work to contact ticket holders and patrons in a timely manner to transfer their tickets to another show as circumstances permit.

Refunds and Exchanges

  • All ticket sales are final. There will be NO REFUNDS or exchanges for purchased tickets.
  • If you have purchased tickets you are no longer in need of, please reach out to your classmates. LDP will not be responsible for any exchange amongst families.
  • Lost tickets can be recovered by emailing frontdesk@leightondanceproject.com, who will resend you a confirmation via email and/or text. 
  • If you arrive at the theatre and have lost your tickets, patrons must provide proof of purchase, typically a confirmation number or a photo ID, which will confirm the patron’s identity as the original purchaser.
  • If the ticket has already been scanned, the patron will not be admitted into the theatre without another ticket.

Courtesy Pre-Sale Period

  • Leighton Dance Project allows for a courtesy pre-sale period for the families in the specific show. This period may vary, but it can be 48 hours to 2 weeks, which allows for current members to purchase tickets prior to opening tickets to the general public. 

Additional Policies

    • All persons must have a ticket. The only exception will be for children 2 years old or younger, who will be sitting in a ticketed person’s lap for the entirety of the performance. 
    • All ticket sales are subject to convenience fees and city-imposed Amusement Tax. These taxes and fees are added during the checkout process.
    • Note that the event producer and/or artist may change dates, times, and/or venues depending on unforeseen circumstances. Ticket buyers will be updated by the Leighton Dance Project should any change to the schedule or venue occur. 
    • By utilizing a Leighton Dance Project ticket, patrons agree to:
  • Abide by house rules:

    • 1. All patrons, regardless of age, must have a ticket unless otherwise stated.
    • 2. Patrons must sit in the seats for which they have tickets.
    • 3. Resale of tickets for profit is strictly prohibited. The exchange of tickets is acceptable.
    • 4. Outside food or beverages may not be consumed inside the theatre.
    • 5. Beverages purchased through are not permitted inside the auditorium but can be consumed in the lobby. Water is permitted in the auditorium. 
    • 6. Any food items sold at concessions are not permitted inside the auditorium but can be consumed in the lobby.
    • 7. Smoking, including e-cigarettes, is not permitted on location for any events that Leighton Dance Project produces.
    • 8. The use of recording equipment and cameras (with or without flash) during performances is strictly prohibited unless coordinated through management and authorized by the artist(s).
    • 9. Late arrivals are normally seated between movements, acts, or numbers at the discretion of management and at the request of the artist(s).
    • 10. With the exception of service animals assisting disabled persons, pets are not permitted.
    • 11. Patrons may not stand in or block aisles or sightlines at any time during performances unless otherwise stated.
    • 12. Patrons booking accessible seating without need may be reassigned to other seats in the instance that an ADA need arises.
    • 13. Firearms and/or weapons of any kind are strictly prohibited.
    • 14. Balloons of any kind are prohibited in the auditorium. If you have a balloon, we will take it and hold it in our concessions stand upon arrival in the theatre. You will be able to pick it up after the show. 

Violation of the House Rules may result in removal from the performance without refund and could be subject to prosecution at the discretion of Leighton Dance Project or Cordova High School Theatre management.

ADDITIONAL POLICIES

Attendance: If you are going to be absent, please put your absence in the parent portal. The studio reserves the right to (i) remove Student(s) from any performance due to low attendance or frequent tardiness or (ii) require private lessons at an additional expense. 

  • If a dancer is unable to attend class for an extended period of time, tuition will still be charged on the 1st of the month. Dancers will accumulate the appropriate number of make-ups missed during that time and can be rescheduled in the parent portal. 
  • If the client is choosing to drop for the remainder of the season, a drop-request form must be filled out by the 15th of the month prior and your dancer’s spot will not be guaranteed in their previous classes upon your return. 

Holidays, Vacations, and Cancellations: See the studio calendar for date specifics. You are responsible for reading and understanding all dates reflected on the calendar and attending any mandatory rehearsal outlines. 

 

Observations: Parents can observe from any of our observing windows. We invite parents into the studios once per session to enjoy watching their child within the studio setting. 

  • November 18th-23rd: Fall Session Parent Observation Week
  • April 28th – May 3rd: Spring Session Parent Observation Week

 

Makeups: Parents can schedule makeups through the parent portal. Makeups expire after two months and can only be redeemed within the same session and age group. They may not be redeemed in specialty camps, classes, or the Fine Arts Club. Dancers must be active members to redeem makeup classes. 

 

Drop Off/Pick Up: LDP is not responsible for Students before, after, or in between scheduled classes. Check-in of classes occurs from inside the studio at your child’s designated studio.  Check-out of classes will occur at the outside door of the specific class studio (A1, B, C, D, or E). Classes in Studio A2 will check out at the lobby door. Parents of dancers 4th Grade and younger must meet dancers at the studio door to check them out. 

 

Personal Property: LDP is not responsible for lost or stolen items. Items left in the lost and found will be donated at the end of each month without reminder or notice. 

 

Winter Wonderland & Annual Review: I understand that Winter Wonderland and Annual Review dress rehearsals are mandatory and may not be missed for any reason. 

  • Winter Wonderland
    • In-Studio Dress Rehearsal/Photos: December 9th – 14th
    • Tech Rehearsals at Cordova High School: December 17th-19th
    • Performance Days: December 20th & 21st
  • Annual Review
    • In-Studio Dress Rehearsal/Photos: June 2nd-7th
    • Tech Rehearsals at Cordova High School: June 10th-12th
    • Performance Days: June 13th & 14th

 

Dress Code: By participating in the LDP Program, you agree to adhere to the official dress code, which can be found here: LDP Dress Code.

 

CONDITIONS BEYOND CONTROL OF LDP

LDP will not provide refunds or credits for classes, lessons, workshops, musicals, programs, or performances that are canceled, interrupted, or interfered with due to quarantine, pandemic, fire, storm, flood, earthquake, explosions, acts of War, or Terrorism, rebellion, laws, regulations, requirements, rulings or orders of any governmental agency or authority, or act of God. 

 

ON HOLD ACCOUNTS

LDP reserves the right to place an account On Hold when the Student, Parent, any family member or agent, or any child associated with this account breaches this agreement, including violations of LDP’s Anti-Bullying Policy, interferes with LDP’s creative learning environment, damages to LDP property, failure to pay an outstanding balance or for any other reason determined in LDP’s sole discretion. Student, Parent, or agent agrees that while this account is On Hold, (i) any child associated with this account may be dismissed from current activities without refund, and (ii) the Student or Parent will not be able to register any child associated with this account for future activities, either through this account or another account and (iii) any installment plans must be paid IN FULL upon notification of account being placed On Hold. If the sole reason an account is On Hold is because of outstanding balances, payment in full removes an account from being On Hold. If an account is On Hold for any other reason, removing the account from being On Hold is at the sole discretion of LDP. If a Student or Parent registers a child in violation of this account being On Hold, LDP may undo the registration. The Student, Parent, or agent agrees Student, Parent, or agent will lose any processing fees if registration is undone due to an ON HOLD account. 

 

PERFORMANCE PROGRAMS

Company, Crew, and Spotlight

Conflicts must be communicated at enrollment and/or auditions. No new conflicts are accepted after enrollment/auditions. All students may not be required at all rehearsals. LDP reserves the right to dismiss any Student who is frequently late or absent from rehearsals or any Student who misses mandatory rehearsals. I agree that failure to comply with the Participation Policy results in my account being placed On Hold. Participation Policies use the following definition: 

  1. LATENESS: arriving more than 15 minutes late or leaving more than 15 minutes early. 
  2. ABSENCE: missing rehearsals not communicated to all Artistic Directors as well as on BAND. 2 ‘lates’ = 1 absence. Absences due to illness, when accompanied by a doctor’s note, may be accepted at the discretion of LDP. Confidence Coaching may be required at an additional cost. 

 

CONFIDENCE COACHING

Payment Information: 

  • Member Pricing-
  • Price Per Student: 60 Minute Rate $85, 30 Minute Rate $65. Small Groups (up to 4 dancers): add $30 per dancer. 
    • Non-Member Pricing-
      • Price Per Student: 60 Minute Rate $100, 30 Minute Rate $75. Small Groups (up to 4 dancers): add $40 per dancer. 
  • Payment for lessons: The preferred payment method on file will be charged after booking and before the session. If selecting to pay by a different method,  payment must be brought to the lesson in the form of cash or Visa/Mastercard. No refunds are given for any reason once sessions are scheduled and confirmed. 
  • All lessons are non-refundable and non-transferable

 

Session Cancellation: 

  • To cancel a scheduled session, you must give notice at least 48 hours in advance. If the lesson is canceled and/or needs to be rescheduled, a 40% credit will be granted for a future confidence coaching session with the same instructor. Make-up lessons are scheduled at the instructor’s discretion. 
  • The Confidence Coaching form must be filled out at least two weeks in advance. Anything filled out in a short time frame is not guaranteed to be booked and a further request date may be requested. 
  • Once the Confidence Coaching Session is booked, the session will show up in the parent portal under ‘classes.’
  • There are no make-up lessons given for sessions canceled less than 48 hours before the scheduled time for any reason. 
  • If the teacher is unable to give a scheduled session, a make-up session will be scheduled at no additional cost to the client. 

Tardiness: 

  • Sessions will start at their scheduled time. If a student is tardy, the time will not be made up. 
  • Tardiness in excess of 10 minutes will result in a canceled session. The session fees will not be refunded and no make-up session will be scheduled.

 

 

Environment Policy

CREATIVE LEARNING ENVIRONMENT

LDP is committed to providing a creative learning environment. As such, LDP does not tolerate any of the following and any Student, or his/her Parent, family friend, or agent, engaging in any of the following, as determined in the sole discretion of LDP, will result in Student’s dismissal from the current program, without refund, and the account will be put On Hold: (i) physical aggression towards any other person; (ii) refusal to participate; (iii) inability to pay attention or focus; (iv) lack of preparation; (v) disruptive behavior; (vi) verbally abusive or threatening behavior (physical or emotional) towards any other person; (vii) inability to stay in rehearsal room or performance venue without Parent or agent; (viii) causes harm, or threatens to cause harm, to self, others or property of LDP or another; (ix) intentionally exposes a sick or contagious Student or self to others; (x) throws objects; (xi) takes or hides others belongings; (xii) violence; (xiii) vandalism; (xiv) sexual misconduct; or (xv) any other action or inaction that violates the policies and behavior as contemplated by and outlined in this agreement determined in the sole discretion of LDP. Furthermore, the possession, use, and/or sale of cigarettes, alcohol, cannabis, or illegal drugs at the studio, LDP events, performance, and/or competition venues will result in immediate dismissal without refund. 

 

ANTI-BULLYING POLICY

LDP recognizes the harmful effects of bullying. As such, LDP does not tolerate bullying of any kind by either a Student or a Student’s Parent, family members, friends, or agent, especially bullying directed towards another member of the LDP community, be it threatening, physically intimidating, or saying or writing hateful or mean-spirited words anywhere, at any time, associated with an LDP event or performance, either in person or online, or by any other way of communication, be it writing or otherwise, made directly or indirectly to another Student. 

 

PROPERTY DAMAGE

I agree that I am responsible and agree to timely reimburse LDP, for any damage to any LDP property caused by Student, Parent, family member, or agent. LDP property includes costumes and any property for which LDP is responsible, whether or not owned by LDP, such as venue property and rented props. Further, I agree that LDP may put my account On Hold at any time if the Student, Parent, family member, friend, or agent refuses to reimburse LDP for property damage.

RIGHT TO USE LIKENESS

I Authorize LDP to allow Students’ images in photos and videos for print publication/advertising and online on web pages and all social media, including live streaming, for promotional and educational purposes. If you would like for LDP to not use your child in social media or marketing materials please fill out the form linked below. This form is NOT GUARANTEED but a way for us to be notified, and we will be mindful of the request.

Social Media Release of Liability

  • I understand that LDP may use such photographs or videos with or without associating names thereto.
  • I further waive any claim for compensation of any kind for LDP’s use or publication of photographs or videos of my minor child.
  • I hereby fully and forever discharge and release LDP from any claim for damages of any kind (including, but not limited to, invasion of privacy; defamation; false light or misappropriation of names, likeness, or image) arising out of the use or publication of photographs or video of my minor child by LDP, and covenant and agree not to sue or otherwise initiate legal proceedings against LDP for such use or publication on behalf of my minor child. All grants of permission and consent and all covenants, agreements, and understandings contained herein are irrevocable.

 

WAIVER & RELEASE

As a material inducement for LDP to permit Student to participate in any LDP activity, whether in-person, outdoors or via online webcast (including but not limited to: dance, acro, gymnastics, tumbling, performing arts, acting, singing, fitness, yoga and pilates), to use LDP facilities or LDP Equipment, Student (or Parent/Authorized Agent), hereby, on behalf of yourself, your heirs, executors and assigns, fully, forever and irrevocably waive, release and hold LDP harmless from any and all claims (including, to the extent permitted by applicable law, claims alleging negligence on behalf of LDP, injuries, death, damage or loss (including legal fees), present or future, foreseen or unforeseen, anticipated or unanticipated (collectively “Claims”), that you, Student, Student’s family and/or Student’s guests have (or that accrue to the same) against LDP and generally release and discharge LDP, their employees, agents, representatives, elected officials, contractors, subcontractors, successors, heirs, assigns, lessors, affiliates, volunteers and legal representatives from any and all claims, including but not limited to those involving (i) participating in any supervised or unsupervised dance, acro, gymnastics, tumbling, performing arts, acting, singing, fitness, yoga, pilates and other fitness activities, (ii) use of any fitness training equipment, props, sets, including LDP Equipments, (iii) any loss or theft of personal property, and (iv) accidental injuries, such as “slip and fall” injuries on or outside of LDP premisses, licensed areas, and/or venues and Student (or Parent/Authorized Agent), hereby promise never to assert or assist any other party in asserting, any claims or causes of action against LDP in any matter that in any way relates to and Claims. 

 

LIMITATION OF LIABILITY

The parties to this agreement acknowledge and agree that LDP and none of its employees, Kelli Leighton, or any of its agents are personally liable for any litigation or disputes arising hereunder, whether direct or indirect and of any nature whatsoever. Any liability of LDP, Kelli Leighton, or its agents alleged by Student or Parent shall be limited to three (3) months of Student’s payments to LDP for the activity registered by Parent/Student during the period triggering liability (“Liability Period”). If a Student registers for multiple activities during the Liability Period, the LDP’s liability shall be limited to three (3) months of payments for only one activity, whatever is the lowest. Student and Parent agree to look only to LDP’s/Kelli Leighton’s/agent’s role under this agreement and not to LDP/Kelli Leighton/agent personally, and no other property or assets of LDP or Kelli Leighton or agent shall be subject to levy, execution or other enforcement procedure for the satisfaction of Student’s/Parent’s claims under or with respect to this agreement. 

 

SEVERABILITY

Student expressly agrees that this agreement is governed by the State of California and is intended to be as broad and inclusive as permitted by California law and that in the event any portion of this agreement is determined to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the balance of the agreement shall not be affected or impaired in any way and shall continue in full legal force and effect. 

 

VENUE

The student agrees that if, in spite of this contract, legal action is brought regarding a claim, it must be brought in the Superior Court of California, County of Sacramento, and further agrees that the substantive laws of the State of California shall apply in any action brought. 

 

ATTORNEY’S FEES

Student acknowledges that this agreement is a contract and agrees that in the event of a dispute, claim, action, proceeding, pre-litigation matters, or lawsuit arising from or in connection with the execution, noon-performance, or breach of any obligation of this agreement, Student shall pay all attorney’s fees and costs, including, without limitation, expert witness fees and costs, incurred by LDP. 

 

INCORPORATION

The BAYPAC Agreement for Parents and Students and LDP Participation Policies are fully incorporated herein by reference.   

 ENTIRE AGREEMENT

This agreement is the entire agreement between the parties with respect to the subject matter hereof and supersedes all statements, negotiations, agreements, and understandings not herein included or referenced. This agreement may only be amended by a written document signed by all parties.
